ODS Gardening
Terms and Conditions Agreement Effective Date: 01/01/2025This Agreement ("Agreement") is entered into between ODS Gardening ("the Service ProviderI" "weI" "ourI" or "us") and the client ("the Client" or "you") whose details are set forth below. These terms and conditions govern the services provided by the Service Provider to the Client.
1. Services Provided
The Service Provider agrees to perform the following services ("Services") for the Client:
• Lawn care and maintenance
• Hedge trimming and pruning
• Weeding, planting, and border design
• Garden clearance and waste removal
• Landscaping and garden design
• Seasonal garden work and one-off jobsDetails of specific services, including the scope of work, will be agreed upon in writing (e.g. through a quotation or service contract).
2. Quotations and Pricing
• All quotations provided are valid for 30
days unless otherwise stated.
• The quoted prices include VAT (if applicable) and are based on the information provided at the time of
quotation.
• Any additional work not covered in the initial quotation may incur additional charges, which will be agreed upon in
advance.
• The Client acknowledges that any materials or goods (e.g., plants, turf, equipment) purchased for the project
may incur separate charges.
3. Materials and Supply of Goods
• The Service Provider will source and provide materials, which will beincluded in the final quotation or charged separately.
• Specific materials requested by the Client may require upfront payment and
are non-refundable once purchased.
• Ownership of all materials remains with the Service Provider until full
payment is received.
• Service provider retains ownership of all unused materials after payment is
received.
4. Booking and Payment
• The Client agrees to pay for services rendered upon completion, unless
otherwise agreed in writing.
• Accepted payment methods include cash, bank transfer, or card payment (if
available).
• For projects over £150, a deposit may be required before commencement.
• Invoices must be paid in full within 7
days of the date issued, unlessotherwise agreed in writing.
5. Late Payment Terms
• If payment is not received within 7 days of the due date, a late payment charge of 20% of the outstanding balance will
be applied, which may increase monthly until payment is made.
• The Service Provider reserves the right
to suspend or cancel services until all overdue payments are received.
• The Client agrees that statutory
interest, BoE base rate and debt recovery costs may be applied for overdue payments, as per the Late Payment of Commercial Debts (Interest) Act 1998.
6. Cancellations and
Rescheduling
• Cancellations or changes to scheduled services must be made at least 24
hours prior to the appointment.
• Late cancellations, cancellations onarrival or late rescheduling may incur a charge of up to 50% of the agreed fee.
• The Client acknowledges that repeated cancellations may affect the availability
of future services.
7. Access to Property
• The Client agrees to ensure that there is clear and safe access to the property
where services are to be performed.
• Pets should be secured, and any potential hazards in and around lawns, garden (e.g., broken glass, loose metal,
small brick) should be removed or secured.
• The Service Provider reserves the right
to charge a call-out fee or reschedule services if access is obstructed or unsafe.
8. Dog Waste
• The Client agrees to remove all dog
waste from the work area before the Service Provider's arrival to ensure asafe and hygienic working environment.
• If dog waste is not cleared, an additional charge of £5 may apply for
disposal or rescheduling of the job.
• In cases where dog waste is encountered during the work, the
Service Provider may suspend work until the area is cleared.
9. Weather Conditions
• In the event of adverse weather conditions, the Service Provider may
need to reschedule or postpone services for safety & quality of service reasons.
• The Service Provider will inform the
Client of any changes as soon as possible and will work to reschedule services at the earliest available time.
10. Liability and Insurance
• The Service Provider holds full Public Liability Insurance to cover accidental damage or injury caused by the team.• The Service Provider is not responsible for damage to underground cables,
pipes, or systems that were not disclosed prior to work commencing.
• The Service Provider will not be liable
for any damages resulting from external factors such as weather, pests, or wildlife.
11. Complaints and Service
Issues
• If the Client is dissatisfied with any aspect of the services provided, they must notify the Service Provider within
48 hours of service completion.
• The Service Provider will make every reasonable effort to address and
resolve any issues promptly.
12. Termination of Services
• The Service Provider reserves the right to terminate services if:
• The Client fails to make payment in
accordance with the agreed terms.• There is abusive or unsafe behaviour toward the Service Provider's staff.
• The Client repeatedly cancels or reschedules appointments.
13. Data Protection
• The Service Provider complies with the
UK General Data Protection Regulation (GDPR).
• The Client's personal data will be stored securely and only used for purposes related to the provision of
servi•ces.
• The Service Provider will not share or disclose any personal data without the Client's consent, unless required by law.
14. Governing Law
• This Agreement is governed by the laws of England and Wales.
• Any disputes arising from this Agreement will be resolved in the
courts of England and Wales.
15. Client Acknowledgementand Agreement
the Client acknowledges that they have read, understood, and agree to the Terms and Conditions set out above. The Client confirms that they have provided accurate information, and consent to the Service Provider performing the agreed-upon services in accordance with these terms.
